Event Terms and Conditions

1. Parties, Definitions, and Acceptance of Terms

1.1Organizer Identity

These Event Terms and Conditions (“Terms”) are issued by Outright Play (Pvt) Ltd, a company duly incorporated under the laws of Sri Lanka (the “Organizer”), which is the sole contracting party under these Terms and the entity responsible for producing and promoting the Event.
No sponsor, venue owner, artist, vendor, contractor, or other third party is a contracting party to these Terms.

1.2Definitions

For the purposes of these Terms, the following definitions shall apply:
“Event” means any live concert, festival, performance, show, activation, exhibition, experience, or related gathering, whether single-day or multi-day, produced, promoted, organized, hosted, or operated by Outright Play (Pvt) Ltd under any of its brands, including all associated programming, performances, activities, hospitality areas, sponsor activations, ancillary events, and designated zones at or in connection with the Venue, to which a Ticket grants admission.
“Organizer” means Outright Play (Pvt) Ltd, the sole legal entity that contracts with Purchasers and Attendees under these Terms.
“Ticket” means any physical, electronic, digital, or other access instrument or entitlement issued, sold, allocated, transferred, or otherwise made available by or on behalf of the Organizer that provides or purports to provide admission to, access within, or participation in the Event, whether free or paid, including without limitation any QR code, barcode, e-ticket, wristband, badge, pass, credential, invitation, accreditation, voucher, token, digital wallet ticket, or other access identifier, and includes any associated access rights, tier privileges, upgrades, add-ons, and entitlements, each of which constitutes a limited, personal, revocable license to attend or access the Event strictly in accordance with these Terms.
“Purchaser” means any individual or entity that purchases, orders, reserves, obtains, redeems, is issued, or otherwise acquires a Ticket through any Official Channel or authorized allocation, whether for their own use or on behalf of any other person, including without limitation any corporate purchaser, group purchaser, sponsor, partner, agent, representative, or any person who completes checkout, provides payment details, or supplies purchaser information in connection with a Ticket transaction or allocation.
“Attendee” means any individual who enters, attempts to enter, is present at, participates in, or remains within the Venue or any surrounding controlled area in connection with the Event, whether or not they purchased a Ticket, and includes without limitation any Ticket holder, transferee, guest, invitee, companion, minor, complimentary or promotional pass holder, VIP credential holder, media or staff accreditation holder, vendor or sponsor guest, artist guest, or any other person granted access to the Event or Venue by or on behalf of the Organizer.
“Venue” means the location(s) at which the Event is held, including all premises, buildings, grounds, temporary structures, stages, viewing areas, access-controlled zones, hospitality areas, vendor areas, sponsor areas, entrances, exits, queuing areas, screening points, loading zones, back-of-house areas, and any surrounding or adjacent areas designated or controlled by the Organizer or venue operator in connection with the Event (including car parks, drop-off points, and perimeter control areas), and includes any alternative or replacement venue or location notified by the Organizer. References to the Venue include any area where Event-related activities are conducted or where Event staff or security are deployed for Event purposes.
“Official Channels” means only those websites, mobile applications, ticketing platforms, sales outlets, payment links, social media accounts, customer support channels, and communication methods that are expressly designated or verified by the Organizer for a particular Event, including any authorized ticketing partners or resellers announced by the Organizer, and excludes all unofficial pages, secondary marketplaces, brokers, third-party social media sellers, and any other source not expressly authorized in writing by the Organizer.
“Privacy Notice” means the Organizer’s privacy policy or data protection notice (and any cookie notice where applicable) published through Official Channels, as amended, updated, or replaced from time to time, which describes how the Organizer and its authorized service providers collect, use, store, share, transfer, and otherwise process personal data in connection with the Event, Ticket purchases, entry management, security operations (including CCTV), marketing communications, and related services.
“Force Majeure Event” means any event, circumstance, or combination of events beyond the reasonable control of the Organizer which prevents, hinders, delays, disrupts, makes unsafe, makes unlawful, or renders the planning, production, performance, continuation, or delivery of the Event impossible, unlawful, or unsafe, in whole or in part, including without limitation: acts of God; severe or unsafe weather (including lightning, storms, flooding, extreme heat); natural disasters; fire; epidemic or pandemic; public health emergencies; war, terrorism, or security threats; civil unrest; strikes or labor disputes; transport disruption; power failure or telecommunications failure; venue unavailability, damage, or shutdown; governmental orders, restrictions, curfews, licensing decisions, or regulatory action; artist illness or inability to travel; failure or delay of suppliers, contractors, or technical infrastructure; and any other cause of a similar nature outside the Organizer’s reasonable control.
“Prohibited Items” means any item which is illegal, restricted, unsafe, or otherwise prohibited at the Venue by applicable law, Venue rules, licensing conditions, or the Organizer’s policies, or which the Organizer reasonably determines may pose a safety, security, operational, or public order risk, or may interfere with the Event, performers, production, or the enjoyment of other Attendees, including without limitation: weapons or items capable of being used as weapons; explosives, fireworks, flares, or flammable materials; illegal drugs or controlled substances; outside alcohol; glass containers; hazardous chemicals; drones; laser pointers; professional recording equipment without authorization; large flags, poles, or items that obstruct views; and any other item notified as prohibited through Official Channels or by on-site signage or staff instructions.
“Access Credential” means any mechanism, identifier, or item used to evidence or enable entry to, movement within, or benefits at the Venue or Event, including without limitation any wristband, badge, pass, lanyard, stamp, QR code, barcode, NFC/RFID credential, digital wallet pass, ticket upgrade, guest list confirmation, or other access identifier, whether physical or digital, and whether issued permanently or temporarily.
“Released Parties” means, collectively, the Organizer’s affiliates, directors, officers, employees, contractors, agents, production partners, venue owners and operators, artists, performers, sponsors, vendors, service providers, and any other persons engaged in connection with the Event. Released Parties are not contracting parties under these Terms but are intended third-party beneficiaries of provisions that expressly grant them rights, protections, releases, or limitations of liability.
“Vendor” means any independent third party that provides goods or services at, for, or in connection with the Event, including without limitation food and beverage providers, merchandise sellers, exhibitors, contractors, subcontractors, technicians, security contractors, parking operators, medical providers, and other service providers, whether engaged directly by the Organizer or operating under permission of the Venue or sponsor.
“Sponsor” means any person or entity that funds, supports, advertises with, partners with, or is otherwise associated with the Event for branding, promotional, hospitality, activation, or marketing purposes, including its employees, agents, contractors, and activation partners.
“Service Fees” means any booking fee, platform fee, convenience fee, processing fee, administrative fee, delivery fee, or similar charge applied in connection with the sale, issuance, transfer, administration, or servicing of Tickets, including any non-recoverable payment processing costs to the extent permitted by law.
“Non-Refundable Deposit” means any portion of the Ticket price or payment designated by the Organizer at the time of purchase as non-refundable, including deposits collected for multi-day festivals, installment plans, staged payments, reservations, VIP packages, add-ons, or upgrades, which contributes toward non-recoverable production, artist, venue, infrastructure, staffing, and operational costs.
“Dispute” means any claim, complaint, disagreement, controversy, or proceeding of any nature arising out of or in connection with the Event, a Ticket, an Access Credential, entry to or attendance at the Venue, these Terms, or any related communication or transaction, whether asserted in contract, tort, negligence, statute, or otherwise.
“Cancellation” means the complete and permanent cancellation of the Event by the Organizer such that the Event will not take place in any form on a future date, as determined by the Organizer acting reasonably and in good faith.
“Postponement” means the rescheduling of the Event to a different date and/or time, whether at the same Venue or an alternative Venue, and may include changes to format or programming that do not constitute a Cancellation.
“Material Alteration” means a substantial change to the core nature of the Event, as determined by the Organizer acting reasonably and in good faith, excluding artist substitutions, timetable changes, production or technical changes, and operational changes implemented for safety, capacity, weather, regulatory compliance, or security reasons.

1.3Contract Formation and Binding Effect

These Terms constitute a legally binding agreement between the Organizer and each Purchaser and Attendee.
A binding contract is formed when:
  • (a)
    a Purchaser completes the purchase or acquisition of a Ticket through an Official Channel; or
  • (b)
    an Attendee accepts, possesses, uses, or attempts to use a Ticket; or
  • (c)
    an individual enters or attempts to enter the Venue or participates in any part of the Event.
Each Ticket grants a limited, revocable license to enter and attend the Event subject strictly to compliance with these Terms and any additional policies referenced herein.
The Organizer reserves the right to modify these Terms prior to the Event for legitimate operational, legal, or regulatory reasons, provided that any material amendments shall be published through Official Channels.
These Terms govern admission to and attendance at the Event only and do not constitute the terms governing general access to or use of the Organizer’s website, mobile applications, or ticketing platform, which may be subject to separate terms and conditions.

1.4Acceptance by Purchasers and Attendees

By purchasing, acquiring, possessing, using, or attempting to use a Ticket, or by entering or remaining at the Venue, each Purchaser and Attendee:
  • (a)
    acknowledges that they have read, understood, and agreed to be bound by these Terms;
  • (b)
    agrees to comply with all applicable laws, Venue regulations, security procedures, and Organizer instructions;
  • (c)
    acknowledges that attendance at the Event is voluntary and subject to inherent risks as further described in these Terms.
If any individual does not agree to these Terms, that individual must not purchase a Ticket, must not enter the Venue, and must immediately leave the Venue upon request.

1.5Electronic Acceptance and Binding Effect

Where a Ticket is purchased or obtained through electronic means, including through the Organizer’s website, mobile application, or authorized digital platform, the Purchaser acknowledges that checking an acceptance box, clicking an “I agree” button, completing a transaction, or otherwise proceeding with the purchase constitutes electronic acceptance of these Terms.
The Parties agree that electronic acceptance shall have the same legal force and effect as a handwritten signature and shall constitute a binding agreement between the Organizer and the Purchaser.
The Purchaser further agrees that electronic records of the transaction maintained by the Organizer or its authorized ticketing partners shall be admissible as evidence of acceptance and transaction completion.

1.6Application to Transferees, Guests, and Pass Holders

These Terms apply equally and without limitation to:
  • (a)
    any person to whom a Ticket is transferred, gifted, or otherwise provided;
  • (b)
    guests accompanying a Purchaser;
  • (c)
    holders of complimentary Tickets, promotional passes, media accreditation, artist or crew passes, VIP credentials, sponsor passes, or any other form of access credential.
The Purchaser represents and warrants that they have authority to accept these Terms on behalf of any person for whom they purchase or acquire a Ticket and shall ensure that such persons are informed of and comply with these Terms.
Any transfer of a Ticket does not relieve the original Purchaser or the transferee of obligations under these Terms. The use of a transferred Ticket constitutes acceptance of these Terms by the transferee.
All persons entering the Venue are bound by these Terms regardless of whether they personally completed the Ticket purchase.

2. Nature of Ticket and License

2.1Ticket as Revocable License

Each Ticket issued for an Event constitutes a limited, personal, revocable license granted by the Organizer to the Attendee to enter the Venue and attend the Event strictly in accordance with these Terms and any additional published policies.
A Ticket:
  • (a)
    does not confer any ownership, leasehold, or proprietary rights in the Event, the Venue, or any seating or standing location;
  • (b)
    does not guarantee admission, a particular view, performance duration, artist appearance, production element, or any specific experience;
  • (c)
    is conditional upon full compliance with these Terms and all lawful instructions of the Organizer and Venue personnel.
The Organizer retains discretion, acting reasonably and in good faith, over operational, safety, production, and access decisions relating to the Event and the Venue.

2.2Ownership and Revocation Rights

All Tickets remain the property of the Organizer at all times.
The Organizer reserves the right, acting reasonably and in good faith, and without liability beyond any applicable refund policy, to:
  • (a)
    revoke, cancel, invalidate, or refuse any Ticket;
  • (b)
    refuse entry to, or remove from the Venue, any Attendee;
  • (c)
    restrict or modify access to particular areas of the Venue;
  • (d)
    reconfigure seating, standing, or viewing arrangements;
  • (e)
    enforce any safety, security, capacity, legal, or operational requirement.
Revocation or refusal of entry may occur without prior notice where the Organizer reasonably determines that:
  • (i)
    an Attendee has breached these Terms;
  • (ii)
    a Ticket has been resold or transferred in violation of these Terms;
  • (iii)
    payment for the Ticket has been reversed, disputed, or determined to be fraudulent;
  • (iv)
    the presence or conduct of an Attendee poses a safety, security, reputational, or operational risk; or
  • (v)
    compliance with law, government order, or Venue requirements so requires.
Where a Ticket is revoked due to breach of these Terms or misconduct, no refund or compensation shall be payable unless otherwise required by applicable law.

2.3Conditions of Validity

A Ticket shall only be valid if:
  • (a)
    it has been purchased or issued through Official Channels or otherwise expressly authorized by the Organizer;
  • (b)
    it has not been altered, defaced, duplicated, resold in breach of these Terms, or obtained through fraudulent or unlawful means;
  • (c)
    payment for the Ticket has been successfully completed and not subsequently reversed, charged back, disputed, or cancelled;
  • (d)
    the Attendee presents valid identification or proof of purchase if reasonably requested by the Organizer;
  • (e)
    the Ticket or associated access credential, including any wristband, remains intact, untampered, and legible.
The Organizer reserves the right to invalidate any Ticket that fails to meet these conditions without obligation to provide compensation.
Possession of a Ticket does not guarantee admission to the Event if the Attendee fails to comply with these Terms or if admission would exceed Venue capacity, compromise safety, or violate applicable law or regulatory requirements.
The Organizer shall not be liable for lost, stolen, destroyed, damaged, duplicated, or fraudulently obtained Tickets, except as expressly provided under any published replacement policy.

3. Ticket Purchase, Validity, and Fraud Prevention

3.1Authorized Sales Channels

Tickets shall be valid only if purchased or issued through Official Channels expressly authorized by the Organizer.
The Organizer does not guarantee the authenticity, validity, or enforceability of Tickets acquired through unauthorized resellers, secondary marketplaces, brokers, social media platforms, private transactions, or any source not approved in writing by the Organizer.
The Organizer reserves the right to invalidate, refuse, or cancel any Ticket reasonably believed to have been purchased through an unauthorized channel, without liability or obligation to refund, except as required by applicable law.
The Organizer shall not be responsible for losses arising from fraudulent transactions, counterfeit Tickets, duplicate QR codes, or unauthorized resales.

3.2Invalid, Fraudulent, or Resold Tickets

A Ticket shall be deemed invalid if it:
  • (a)
    has been altered, copied, duplicated, counterfeited, or tampered with in any manner;
  • (b)
    has been resold, transferred, or used for commercial or promotional purposes in breach of these Terms;
  • (c)
    was obtained through fraudulent activity, including stolen payment credentials or identity theft;
  • (d)
    is subject to a payment dispute, chargeback, reversal, or cancellation;
  • (e)
    has been reported lost or stolen;
  • (f)
    violates any purchase limit or anti-scalping restriction imposed by the Organizer.
The Organizer reserves the right to cancel or refuse any Ticket determined to be invalid. Admission shall be denied to the holder of any invalid Ticket, and no refund or compensation shall be payable unless required by law.
Where multiple copies of a Ticket or QR code are presented for entry, the Organizer reserves the right to admit only the first validated scan and to deny entry to any subsequent duplicate.

3.3Anti-Scalping and Resale Restrictions

Tickets are sold for personal use only and may not be resold, offered for resale, transferred for commercial gain, auctioned, advertised, or otherwise distributed in connection with any commercial activity without the prior written consent of the Organizer.
The Organizer may, acting reasonably:
  • (a)
    limit or prohibit the transfer of Tickets;
  • (b)
    designate approved resale or transfer mechanisms through Official Channels;
  • (c)
    cancel Tickets resold or transferred in violation of these Terms;
  • (d)
    restrict future purchases by individuals found to be engaged in unauthorized resale practices.
The use of Tickets for promotional, marketing, sweepstakes, hospitality, or business purposes without express written authorization from the Organizer is strictly prohibited.
The Organizer reserves the right to pursue legal remedies against individuals or entities engaged in unauthorized resale, including recovery of damages and injunctive relief.

3.4Order Limits and Bot Prevention

The Organizer reserves the right to impose limits on the number of Tickets that may be purchased by any individual, household, email address, payment method, IP address, or entity.
The use of automated purchasing software, bots, scripts, scraping tools, or other technological means designed to circumvent purchase limits or security measures is strictly prohibited.
The Organizer may cancel or void any order that, in its reasonable determination:
  • (a)
    exceeds purchase limits;
  • (b)
    involves the use of automated systems;
  • (c)
    appears to be part of a coordinated bulk purchasing effort;
  • (d)
    presents a fraud risk or abnormal transaction pattern.
Orders cancelled under this Section may be refunded in accordance with the refund principles set out in Section 8, less any non-recoverable processing costs where legally permissible.
The Organizer reserves the right to block access to its ticketing systems for any user suspected of violating this Section.

3.5Identification and Entry Verification

The Organizer reserves the right to require Attendees to present valid government-issued identification, proof of purchase, the original payment method used for purchase, or other verification reasonably necessary to confirm the legitimacy of a Ticket.
Where Tickets are issued in the name of a Purchaser, entry may be conditioned upon verification of identity.
Failure to provide requested verification may result in refusal of entry without refund, unless otherwise required by law.
The Organizer may implement additional verification measures, including entry scanning, wristband activation, digital authentication, and anti-duplication technology.

3.6Chargebacks and Payment Reversals

If a payment for a Ticket is disputed, reversed, charged back, or otherwise cancelled by the issuing bank, payment processor, or card network, the associated Ticket shall be deemed automatically invalid unless and until full payment is successfully reinstated.
The Organizer reserves the right to:
  • (a)
    cancel any Ticket associated with a disputed or reversed payment;
  • (b)
    refuse entry to the holder of such Ticket;
  • (c)
    suspend or block future purchases by the Purchaser or related accounts;
  • (d)
    recover any costs, administrative fees, or losses incurred in connection with the dispute, to the extent permitted by law.
Initiating a chargeback or payment dispute in bad faith or without valid grounds may result in cancellation of the associated Ticket and restriction of future purchases, to the extent permitted by law.
The Organizer reserves the right to provide transaction records, IP address data, device information, entry scans, policy acceptance records, and related documentation to payment processors, banks, or dispute resolution bodies in order to contest chargebacks or fraud claims.
Nothing in this Section shall limit any rights afforded to consumers under applicable law, but the Organizer’s rights under these Terms shall be enforceable to the fullest extent permitted by law.
The initiation of a chargeback without valid legal grounds after lawful provision of Ticket access may constitute a breach of these Terms and may result in suspension or restriction of future purchasing privileges, subject to applicable law.

3.7QR Code and Entry Disclaimer

Each Ticket is issued with a unique QR code or Access Credential and is valid only for the number of admissions corresponding to the Ticket category purchased. A QR code shall be deemed redeemed upon the first valid scan(s) up to the permitted entry limit, after which it shall automatically become void and invalid for further use.
The Organizer shall grant entry solely to the first person(s) presenting a valid QR code and shall have no obligation to investigate or resolve any dispute arising from duplication, copying, screenshot sharing, unauthorized transfer, resale, theft, or other misuse of a QR code. The Purchaser and Attendee assume full responsibility for safeguarding their QR code and Access Credential, and the Organizer shall not be liable for any loss, denial of entry, or related consequence resulting from its unauthorized use.

4. Ticket Transfers and Group Attendance

4.1Permitted Transfers

Tickets may only be transferred, reassigned, or gifted where such transfer is expressly permitted by the Organizer and carried out strictly in accordance with the procedures, systems, or mechanisms designated through Official Channels.
The Organizer reserves the right, acting reasonably, to:
  • (a)
    prohibit transfers entirely for a particular Event or Ticket category;
  • (b)
    limit the number of permitted transfers;
  • (c)
    require transfers to occur exclusively through an approved digital transfer function;
  • (d)
    impose verification requirements or administrative conditions for transfers.
Any transfer attempted outside an authorized mechanism, or in breach of these Terms, shall render the Ticket invalid and subject to cancellation without refund unless otherwise required by applicable law.
The Organizer shall not be responsible for disputes arising between transferors and transferees, including disputes concerning payment, consideration, or delivery of transferred Tickets.

4.2Binding Effect on Transferees

Any person who receives, accepts, uses, or attempts to use a transferred Ticket shall be deemed an Attendee for the purposes of these Terms and shall be fully bound by them upon receipt or use of the Ticket, whether or not such person has directly purchased the Ticket.
Use of a transferred Ticket constitutes acceptance of these Terms in full.
No transfer shall operate to vary, waive, or limit any rights of the Organizer under these Terms.
The Organizer reserves the right to require identity verification of a transferee where reasonably necessary for security, fraud prevention, or operational purposes.

4.3Responsibility of Purchaser

The Purchaser represents and warrants that:
  • (a)
    they have authority to transfer any Ticket in accordance with these Terms;
  • (b)
    they have informed any transferee, guest, or invitee of the applicability of these Terms;
  • (c)
    they shall ensure that any transferee or guest complies fully with these Terms.
The Purchaser shall remain responsible for ensuring that any transferee or guest complies with these Terms and may be held liable for losses directly caused by breaches arising from the use of a Ticket originally purchased by the Purchaser.
The Organizer shall not be liable for any loss arising from the Purchaser’s failure to properly transfer a Ticket through an authorized process, including loss of access due to duplicate scans, fraud, or cancellation.

4.4Complimentary and Promotional Passes

Complimentary Tickets, promotional passes, VIP credentials, sponsor allocations, media accreditations, artist or crew passes, hospitality passes, and any other non-publicly sold access credentials are issued at the Organizer’s discretion.
Such passes:
  • (a)
    are strictly non-transferable unless expressly authorized in writing by the Organizer;
  • (b)
    may be revoked at any time without compensation;
  • (c)
    remain the property of the Organizer;
  • (d)
    may be subject to additional conditions communicated at the time of issuance.
Holders of complimentary or promotional passes are bound by these Terms in the same manner as Purchasers and Attendees, including all conduct, liability, and media release provisions.
The Organizer reserves the right to cancel any complimentary or promotional pass issued in error, obtained through misrepresentation, or used in breach of these Terms.

5. Pricing, Fees, Taxes, and Payment Terms

5.1Ticket Price Components

The total amount payable for a Ticket may include, as applicable:
  • (a)
    the face value of the Ticket;
  • (b)
    service, booking, platform, convenience, or administrative fees;
  • (c)
    delivery or digital processing fees;
  • (d)
    applicable taxes, duties, or government levies;
  • (e)
    any additional charges clearly disclosed at the time of purchase.
The total purchase price shall be displayed prior to confirmation of payment. By completing the transaction, the Purchaser agrees to pay the full amount presented at checkout.
The Organizer reserves the right to structure pricing across different ticket tiers, phases, allocations, and promotional periods at its discretion.

5.2Service and Platform Fees

Service fees, booking fees, platform fees, convenience charges, and similar administrative fees are charged in consideration of ticketing services, technology infrastructure, fraud prevention measures, payment processing, customer support, and operational costs.
Unless expressly stated otherwise in a published refund policy:
  • (a)
    service and platform fees are non-refundable;
  • (b)
    such fees may be retained by the Organizer or its ticketing partners even where the face value of a Ticket is refunded;
  • (c)
    third-party processing costs that are non-recoverable may be deducted from any refund to the extent permitted by law.
The Organizer reserves the right to revise fee structures for future Events without prior notice.

5.3Taxes and Government Levies

Ticket prices may include or be subject to taxes, duties, regulatory charges, or government-imposed levies as required under applicable Sri Lankan law.
Where required by law, taxes shall be collected and remitted to the appropriate authorities.
If any new tax, levy, or regulatory charge is introduced or modified after a Ticket has been placed on sale but prior to the Event, the Organizer reserves the right to adjust pricing accordingly to ensure compliance with legal obligations.
The Organizer shall not be liable for any additional taxes, foreign transaction charges, or banking fees imposed by a Purchaser’s financial institution.

5.4Pricing Errors and Corrections

The Organizer makes reasonable efforts to ensure accurate pricing and ticket information. However, in the event of a typographical error, system malfunction, incorrect price publication, currency display error, or other mistake affecting pricing or availability:
  • (a)
    the Organizer reserves the right to cancel or void the affected order;
  • (b)
    the Purchaser shall be notified of the error;
  • (c)
    the Purchaser may be offered the option to reconfirm the purchase at the correct price, subject to availability.
Where an order is cancelled due to pricing error, the Organizer’s liability shall be limited to refunding the amount actually paid.
The Organizer shall not be liable for any indirect or consequential losses arising from cancellation due to pricing error.

5.5Currency and Foreign Card Transactions

Tickets for Events produced in Sri Lanka are priced in Sri Lankan Rupees (LKR) unless otherwise expressly stated.
Where a Purchaser uses a foreign-issued card or a card denominated in a different currency:
  • (a)
    the issuing bank or card network may apply currency conversion rates;
  • (b)
    additional foreign transaction fees or charges may be imposed by the issuing bank;
  • (c)
    the final amount charged in the Purchaser’s local currency may differ due to exchange rate fluctuations between the time of authorization and settlement.
The Organizer has no control over exchange rates, currency conversion practices, or foreign transaction fees imposed by card issuers or financial institutions and shall not be liable for any differences arising from such conversions.
In the event of a refund, any currency conversion differences, exchange rate losses, or foreign transaction fees applied by the Purchaser’s bank shall be borne solely by the Purchaser.

5.6Payment Processing and Security

Payments for Tickets are processed through authorized payment gateways and banking partners designated by the Organizer.
The Organizer may implement fraud detection systems, identity verification procedures, 3D Secure authentication, transaction monitoring tools, and other security measures to protect against unauthorized or fraudulent transactions.
The Organizer reserves the right to:
  • (a)
    decline or cancel any transaction reasonably suspected of fraud, unauthorized use, or abnormal purchasing behavior;
  • (b)
    request additional verification from a Purchaser before confirming an order;
  • (c)
    suspend or restrict future transactions associated with accounts, payment methods, IP addresses, or devices linked to suspicious activity.
The Organizer does not store full payment card details except as permitted and secured in accordance with applicable data protection and payment security standards.
Completion of a payment transaction constitutes authorization for the Organizer and its payment processing partners to charge the specified amount using the selected payment method.
The Organizer shall not be liable for payment failures resulting from:
  • (a)
    incorrect payment details provided by the Purchaser;
  • (b)
    insufficient funds or credit limits;
  • (c)
    bank or gateway system interruptions;
  • (d)
    network disruptions or technical failures beyond the Organizer’s reasonable control.
Where a payment is not successfully completed, the associated Ticket shall not be deemed confirmed.
The Organizer acts solely as the merchant of record for Ticket transactions. Payment authorization by a card issuer or payment gateway does not constitute final settlement of funds. A transaction shall only be deemed completed once funds have been successfully received and settled to the Organizer through the designated payment processing infrastructure.
Any dispute relating to card payments, including chargebacks, retrieval requests, or transaction reversals, shall be handled in accordance with the rules and procedures of the applicable card network and issuing financial institution. The Purchaser acknowledges that the Organizer has no control over the internal dispute resolution procedures of issuing banks or card schemes and agrees to cooperate in good faith in resolving any such dispute.

5.7Non-Refundable Deposits for Multi-Day or Installment Payments

For certain Events, including multi-day festivals or Events offered on an installment or staged payment basis, the Organizer may designate a portion of the Ticket price as a non-refundable deposit.
Where a Ticket is purchased on an installment plan or partial payment basis, the initial deposit shall secure the reservation of Ticket inventory and contribute toward non-recoverable production, artist, and infrastructure costs.
Unless the Event is cancelled in its entirety in accordance with Section 8, such deposit shall be non-refundable, except to the extent required by applicable law, including in circumstances where the Purchaser elects not to complete remaining installment payments or chooses not to attend the Event.
Any remaining refund eligibility, where applicable, shall apply only to amounts paid in excess of the designated non-refundable deposit and shall be subject to the terms of Section 8.
The amount designated as a non-refundable deposit shall be clearly disclosed at the time of purchase.

6. Entry, Refusal, and Removal

6.1Right of Admission Reserved

The Organizer reserves the right to admit or refuse admission to the Event and the Venue in accordance with these Terms.
Possession of a valid Ticket does not guarantee entry. Admission is conditional upon compliance with these Terms, applicable laws, Venue regulations, security procedures, and instructions issued by the Organizer, its representatives, or law enforcement authorities.
The Organizer may, in its reasonable discretion:
  • (a)
    refuse entry to any person;
  • (b)
    delay admission;
  • (c)
    restrict access to certain areas of the Venue;
  • (d)
    implement staggered entry procedures;
  • (e)
    suspend entry temporarily for operational or safety reasons.
Such actions may be taken where deemed necessary for safety, security, capacity management, regulatory compliance, or the orderly conduct of the Event.

6.2Grounds for Refusal or Ejection

Without limiting the generality of Section 6.1, the Organizer may refuse entry to or remove from the Venue any Attendee who:
  • (a)
    breaches these Terms or any published Event policies;
  • (b)
    is in possession of Prohibited Items;
  • (c)
    refuses to submit to lawful security screening or search procedures;
  • (d)
    engages in disorderly, disruptive, abusive, discriminatory, violent, or unsafe conduct;
  • (e)
    appears intoxicated to a degree that poses a safety risk;
  • (f)
    damages property or interferes with the enjoyment of the Event by others;
  • (g)
    enters restricted or unauthorized areas;
  • (h)
    presents an invalid, altered, duplicated, or fraudulently obtained Ticket;
  • (i)
    is subject to a chargeback, payment reversal, or unresolved payment dispute;
  • (j)
    fails to comply with lawful instructions of security personnel, Venue management, or emergency services.
Removal may occur without prior warning where the Organizer determines that immediate action is required for safety or security reasons.
Except where required by applicable law, no refund, compensation, or reimbursement shall be payable in connection with any refusal of entry or removal arising from breach of these Terms or misconduct.
The Organizer reserves the right to ban individuals removed for misconduct from future Events.

6.3Capacity and Crowd Control Measures

Admission to the Venue is subject to maximum capacity limits imposed by law, Venue regulations, and safety planning requirements.
The Organizer reserves the right to:
  • (a)
    hold or pause entry temporarily due to crowd density;
  • (b)
    restrict access to specific stages, zones, or viewing areas;
  • (c)
    redirect Attendees to alternative areas within the Venue;
  • (d)
    implement one-way systems, barriers, or controlled movement zones;
  • (e)
    close sections of the Venue for safety, operational, or regulatory reasons.
An Attendee’s inability to access a particular area, stage, or performance due to crowd control or capacity restrictions shall not constitute grounds for refund or compensation.

6.4Re-Entry Policies

Re-entry to the Venue may be prohibited or restricted at the Organizer’s reasonable discretion.
Where re-entry is permitted, Attendees must comply with all exit and re-entry procedures, including wristband scanning, security checks, and identification requirements.
Failure to comply with re-entry procedures, or removal of an access credential while outside the Venue, may result in denial of re-entry without refund.
The Organizer shall not be responsible for lost, stolen, damaged, or removed access credentials that prevent re-entry.

6.5Wristbands and Access Credentials

Where wristbands, badges, or other access credentials are issued, such credentials:
  • (a)
    remain the property of the Organizer;
  • (b)
    must be worn and displayed as instructed at all times while within the Venue;
  • (c)
    must not be removed, altered, shared, transferred, or tampered with.
Any wristband or access credential that is lost, damaged, removed, altered, or transferred in violation of these Terms may be deemed invalid.
The Organizer reserves the right to refuse entry or remove any Attendee who fails to present a valid and intact access credential.
Replacement of lost or damaged wristbands shall be determined by the Organizer acting reasonably and may require identity verification and payment of an administrative fee, where permitted by law.

7. Event Schedule, Lineup, and Production Changes

7.1Artist and Lineup Changes

All advertised artists, performers, speakers, special guests, hosts, or participants are subject to change without prior notice.
The Organizer does not guarantee the appearance, performance, participation, or set duration of any particular artist or performer. Artist cancellations, substitutions, delays, shortened performances, or changes to billing order may occur due to illness, travel disruption, contractual issues, force majeure, or other circumstances beyond the Organizer’s reasonable control.
The withdrawal, cancellation, or substitution of any artist, whether headline or supporting, shall not constitute grounds for refund, exchange, or compensation unless the Event is formally cancelled in its entirety in accordance with Section 8.
Promotional materials, announcements, social media posts, and marketing content are subject to change and shall not create any enforceable entitlement to a specific lineup configuration.

7.2Schedule Modifications

The Organizer reserves the right to modify the Event schedule at any time, including but not limited to:
  • (a)
    start and end times;
  • (b)
    performance order;
  • (c)
    stage allocations;
  • (d)
    intervals, breaks, or curfews;
  • (e)
    event duration;
  • (f)
    daily programming where the Event spans multiple days.
The Event may be delayed, paused, suspended, shortened, or otherwise modified due to weather conditions, safety concerns, crowd management requirements, technical issues, government directives, or any operational necessity.
Temporary interruptions, delays, or partial performance shall not entitle an Attendee to a refund, price reduction, or compensation.
The Organizer may suspend, delay, or evacuate the Event in whole or in part due to severe weather conditions, including lightning or storm risk, and such actions shall not constitute grounds for refund or compensation where the Event substantially proceeds.
The Organizer’s determination as to whether an Event is deemed to have proceeded shall be made in good faith and subject to applicable law.

7.3Production and Technical Changes

The Organizer reserves the right to alter production elements at its reasonable discretion, including but not limited to:
  • (a)
    stage design and layout;
  • (b)
    sound, lighting, and visual effects;
  • (c)
    screen placement and content;
  • (d)
    seating or standing configurations;
  • (e)
    event zones and access areas;
  • (f)
    crowd flow systems and barricade placement.
Changes may be made for safety, technical, artistic, logistical, or regulatory reasons.
No guarantee is made regarding the availability of specific production features, special effects, pyrotechnics, interactive elements, or experiential components advertised in promotional materials.
The Organizer shall not be liable for changes to production design or technical elements that do not materially alter the Event as a whole.

7.4Viewing, Sound, and Experience Disclaimer

The Organizer does not guarantee unobstructed views, proximity to performers, sound quality, or overall Event experience from any particular location within the Venue.
Views may be affected by stage design, equipment, lighting towers, camera platforms, crowd movement, safety barriers, weather conditions, or the actions of other Attendees.
Sound levels may vary depending on location within the Venue and environmental factors.
Attendance at the Event is subject to variable conditions inherent in live performances and large gatherings.
No refund, compensation, or liability shall arise from obstructed views, variable acoustics, crowd density, environmental conditions, or other aspects of the live event environment that do not constitute cancellation of the Event in its entirety.

8. Cancellation, Postponement, and Force Majeure

8.1Definitions

For the purposes of this Section:
“Cancellation” means the complete and permanent abandonment of the Event, such that the Event will not take place in any form at a future date.
“Postponement” means the rescheduling of the Event to a later date, whether at the same Venue or an alternative Venue.
“Force Majeure Event” shall have the meaning assigned in Section 1.2 and includes any event beyond the reasonable control of the Organizer that renders performance of the Event impossible, unlawful, or unsafe.
The Organizer’s determination as to whether an Event is cancelled, postponed, or materially altered shall be made in good faith and subject to applicable law.

8.2Postponement and Rescheduling

In the event of Postponement:
  • (a)
    all valid Tickets shall remain valid for the rescheduled date;
  • (b)
    the Organizer may, acting reasonably and in good faith, offer Ticket holders the option to retain their Tickets for the new date or request a refund within a specified time period;
  • (c)
    failure to request a refund within the specified period, where applicable, shall be deemed acceptance of the rescheduled Event date.
If the rescheduled Event occurs at a different Venue or location within Sri Lanka, Tickets shall remain valid for equivalent access categories, subject to availability and operational requirements.
The Organizer reserves the right to determine seating, access zones, or ticket tier equivalency in connection with a rescheduled Event.

8.3Refund Policy

Refunds shall be provided only in the circumstances expressly set out in this Section or where required by applicable law.
  • (a)
    Cancellation
In the event of a Cancellation, the Organizer shall refund the face value of the Ticket to the original payment method used at the time of purchase, within a reasonable period. Unless otherwise required by applicable law:
  • (i)
    service fees, platform fees, booking fees, administrative charges, and non-recoverable processing costs are non-refundable;
  • (ii)
    refunds shall not include any ancillary or consequential expenses incurred by the Purchaser or Attendee, including travel, accommodation, insurance, merchandise, food, or other personal costs;
  • (iii)
    refunds shall be made only to the original Purchaser of record.
  • (b)
    Postponement
In the event of Postponement, Tickets shall remain valid for the rescheduled date. The Organizer may, acting reasonably and in good faith, offer Ticket holders the option to retain their Tickets for the new date or request a refund within a specified time period. Failure to request a refund within the specified period, where applicable, shall be deemed acceptance of the rescheduled date.
  • (c)
    Material Alteration
For the avoidance of doubt, a Material Alteration shall not constitute a Cancellation and shall not entitle a Ticket holder to a refund unless otherwise required by applicable law.
  • (d)
    No Refund Circumstances
No refund shall be due where:
  • (i)
    the Event proceeds as scheduled;
  • (ii)
    an artist withdraws, is substituted, or performs for a shortened duration;
  • (iii)
    the Event is delayed, interrupted, suspended, or partially completed;
  • (iv)
    access to specific areas is restricted due to safety, capacity, regulatory, or operational requirements;
  • (v)
    an Attendee is refused entry or removed from the Venue in accordance with these Terms;
  • (vi)
    a Ticket is revoked due to breach of these Terms or fraud.
  • (e)
    Refund Process
Refund eligibility may be subject to compliance with a formal refund request procedure and applicable time limits published through Official Channels. The Organizer reserves the right to verify purchase details before issuing any refund.
Nothing in this Section limits any statutory rights that cannot lawfully be excluded or restricted under applicable law.

8.4Credits and Exchanges

At its discretion, acting reasonably and in good faith, the Organizer may offer credits, exchanges, or rollover options in lieu of cash refunds.
Credits may:
  • (a)
    be limited in duration;
  • (b)
    be restricted to specific Events;
  • (c)
    exclude service or administrative fees;
  • (d)
    be non-transferable.
The availability of a credit or exchange option shall not create an ongoing obligation to provide similar remedies for future Events.
Where a credit is accepted by the Ticket holder, such acceptance shall constitute full and final settlement of any claim relating to the cancelled or postponed Event, to the extent permitted by law.

8.5Force Majeure Events

If the Event is cancelled, postponed, delayed, interrupted, or materially altered to the extent caused directly by a Force Majeure Event, the Organizer shall not be deemed in breach of these Terms.
In such circumstances, the Organizer may:
  • (a)
    reschedule the Event;
  • (b)
    modify the Event format, duration, or Venue;
  • (c)
    suspend the Event temporarily;
  • (d)
    cancel the Event.
Where a Force Majeure Event results in Cancellation, refund obligations shall be limited to the face value of the Ticket, unless otherwise required by applicable law.
The Organizer shall not be liable for any failure or delay in performance to the extent caused by a Force Majeure Event.

8.6Limitation of Liability for Related Costs

To the fullest extent permitted by applicable law, the Organizer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from Cancellation, Postponement, schedule changes, or Force Majeure Events.
The Organizer shall not be responsible for any costs or losses incurred by Attendees in connection with the Event, including but not limited to:
  • (a)
    travel expenses;
  • (b)
    accommodation costs;
  • (c)
    insurance premiums;
  • (d)
    lost income or wages;
  • (e)
    transportation charges;
  • (f)
    personal or commercial losses.
Any limitation of liability applicable to Cancellation shall be governed exclusively by Section 12 of these Terms.
Nothing in this Section shall exclude or limit liability to the extent that such exclusion or limitation is prohibited by applicable law.

9. Safety, Security, and Prohibited Items

9.1Search and Screening Procedures

As a condition of entry to the Venue, each Attendee consents to reasonable security screening measures implemented by the Organizer or Venue management.
Such measures may include, without limitation:
  • (a)
    inspection of bags, containers, and personal belongings;
  • (b)
    physical pat-down searches conducted in a respectful and non-discriminatory manner;
  • (c)
    metal detection screening or electronic scanning devices;
  • (d)
    visual inspection of Tickets and access credentials;
  • (e)
    verification of identity where reasonably required.
Refusal to submit to any lawful search or screening procedure shall result in refusal of entry or removal from the Venue without refund, except where otherwise required by applicable law.
Security screening may be repeated upon re-entry or at any time within the Venue where deemed necessary for safety or operational reasons.

9.2Prohibited Items

The Organizer reserves the right to prohibit any item that, in its reasonable judgment, may:
  • (a)
    pose a safety or security risk;
  • (b)
    violate applicable law or Venue regulations;
  • (c)
    interfere with the enjoyment of the Event by others;
  • (d)
    compromise production or operational integrity.
Without limitation, Prohibited Items may include:
  • (i)
    weapons of any kind, including firearms, knives, sharp objects, or items capable of being used as a weapon;
  • (ii)
    explosives, fireworks, flammable materials, or hazardous substances;
  • (iii)
    illegal drugs or controlled substances;
  • (iv)
    glass containers, metal containers, or outside alcohol;
  • (v)
    laser pointers, drones, large flags, poles, or objects obstructing views;
  • (vi)
    professional cameras, audio or video recording equipment without authorization;
  • (vii)
    large bags exceeding size limits as published by the Organizer;
  • (viii)
    any item prohibited by law enforcement or regulatory authorities.
The Organizer may publish a non-exhaustive list of Prohibited Items prior to the Event. Such lists may be updated at any time for safety or compliance reasons.

9.3Confiscation and Disposal

Any Prohibited Item discovered during screening or within the Venue may be confiscated.
Confiscated items may:
  • (a)
    be retained until the conclusion of the Event;
  • (b)
    be permanently removed from the Venue;
  • (c)
    be disposed of without compensation;
  • (d)
    be surrendered to law enforcement where appropriate.
The Organizer shall not be liable for loss, damage, or disposal of confiscated items.
Where the possession of a Prohibited Item constitutes a violation of law, the Organizer may report the matter to law enforcement authorities.

9.4Compliance with Security Instructions

Attendees must comply at all times with:
  • (a)
    instructions issued by the Organizer, security personnel, Venue management, emergency responders, or law enforcement;
  • (b)
    posted signage and public announcements;
  • (c)
    crowd control measures, barriers, and restricted access zones;
  • (d)
    emergency evacuation procedures.
Failure to comply with lawful instructions may result in refusal of entry, removal from the Venue, or involvement of law enforcement.
The Organizer reserves the right to implement emergency procedures, including evacuation or shelter-in-place protocols, without prior notice where required for safety.

9.5Cooperation with Law Enforcement

The Organizer may cooperate fully with law enforcement authorities, regulatory agencies, and emergency services in connection with safety, security, or legal compliance matters.
Attendees acknowledge that:
  • (a)
    certain conduct may result in referral to law enforcement;
  • (b)
    security personnel may detain an individual temporarily where reasonably necessary to prevent harm or preserve order, subject to applicable law;
  • (c)
    personal information and relevant evidence, including CCTV footage, entry logs, and incident reports, may be shared with competent authorities where legally required or reasonably necessary.
Nothing in these Terms shall limit the Organizer’s right to take lawful action to protect the safety, security, and welfare of Attendees, staff, performers, or property.

10. Code of Conduct

10.1General Conduct Standards

All Attendees are expected to conduct themselves in a lawful, respectful, and responsible manner at all times within the Venue and in surrounding controlled areas associated with the Event.
Attendees shall:
  • (a)
    comply with all applicable laws and regulations;
  • (b)
    adhere to these Terms and any published Event policies;
  • (c)
    follow instructions issued by the Organizer, security personnel, Venue staff, and emergency responders;
  • (d)
    respect the safety, dignity, and enjoyment of other Attendees, performers, staff, and contractors;
  • (e)
    refrain from conduct that may endanger themselves or others.
The Organizer reserves the right to determine, in its reasonable discretion, whether conduct violates these standards.

10.2Anti-Harassment and Anti-Discrimination

The Organizer maintains a zero-tolerance policy for harassment, discrimination, intimidation, or abusive conduct of any kind.
Prohibited conduct includes, without limitation:
  • (a)
    verbal abuse, threats, or aggressive behavior;
  • (b)
    unwanted physical contact;
  • (c)
    sexual harassment or sexually explicit conduct;
  • (d)
    discriminatory behavior based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic under applicable law;
  • (e)
    stalking, intimidation, or persistent unwanted attention.
Any Attendee who experiences or witnesses harassment or discriminatory conduct is encouraged to report the matter to Event staff or security personnel.
The Organizer reserves the right to investigate complaints and take appropriate action, including removal from the Venue.

10.3Unsafe or Disruptive Behavior

The following conduct is strictly prohibited:
  • (a)
    engaging in violence, fighting, or inciting others to violence;
  • (b)
    throwing objects, climbing structures, or interfering with staging, barricades, lighting, sound, or technical equipment;
  • (c)
    entering restricted or backstage areas without authorization;
  • (d)
    excessive intoxication that creates a safety risk;
  • (e)
    obstructing walkways, exits, or emergency access routes;
  • (f)
    engaging in conduct that unreasonably interferes with the performance, production, or experience of other Attendees.
Participation in crowd activities that create a foreseeable risk of injury, including uncontrolled surges or hazardous physical behavior, may result in intervention by security personnel.
The Organizer reserves the right to determine when behavior poses a safety or operational risk.

10.4Consequences of Breach

Violation of this Code of Conduct may result in one or more of the following actions, at the Organizer’s reasonable discretion:
  • (a)
    verbal warning;
  • (b)
    restriction of access to certain areas of the Venue;
  • (c)
    confiscation of prohibited items;
  • (d)
    removal from the Venue without refund;
  • (e)
    revocation of Ticket or access credentials;
  • (f)
    prohibition from attending future Events;
  • (g)
    referral to law enforcement authorities where appropriate.
Removal or revocation arising from a breach of this Section shall not entitle the Attendee to any refund or compensation unless otherwise required by applicable law.
The Organizer’s failure to enforce any provision of this Code of Conduct in a particular instance shall not constitute a waiver of its right to enforce such provision in future instances.

10.5False or Defamatory Statements

Attendees shall not knowingly publish false statements of fact concerning the Organizer, the Event, its performers, staff, sponsors, or partners that are made with malicious intent and that materially harm their reputation or business interests.
Nothing in this Section shall prevent an Attendee from expressing honest opinions or making lawful complaints in good faith.
The Organizer reserves the right to pursue appropriate legal remedies in respect of knowingly false or malicious statements that cause demonstrable reputational or commercial harm.

11. Assumption of Risk

11.1Inherent Risks of Attendance

The Attendee acknowledges and understands that attendance at a live event, festival, concert, or large public gathering involves inherent risks that cannot be entirely eliminated.
Such risks may include, without limitation:
  • (a)
    exposure to loud music, amplified sound, and high decibel levels;
  • (b)
    exposure to strobe lighting, flashing lights, pyrotechnics, lasers, smoke effects, and other production elements;
  • (c)
    crowd movement, congestion, pushing, or surging;
  • (d)
    slips, trips, or falls caused by uneven ground, mud, grass, temporary flooring, cabling, barricades, staging components, or crowd density;
  • (e)
    exposure to extreme weather conditions, including high temperatures, humidity, sun exposure, dehydration risks, heavy rain, wind, lightning, and sudden weather changes;
  • (f)
    risks associated with temporary structures, including stages, lighting towers, camera platforms, scaffolding, tents, barriers, and other event infrastructure;
  • (g)
    exposure to high sound pressure levels and amplified music, which may cause temporary or permanent hearing effects;
The Attendee acknowledges that such risks may result in personal injury, illness, property damage, or other harm.

11.2Voluntary Participation

The Attendee voluntarily assumes all risks associated with attending the Event, whether such risks are known or unknown, foreseeable or unforeseeable, except to the extent caused directly by the gross negligence or willful misconduct of the Organizer or any Released Party, where such limitation is prohibited by applicable law.
By entering the Venue, the Attendee confirms that:
  • (a)
    they are physically and medically fit to attend;
  • (b)
    they accept full responsibility for their personal safety and conduct;
  • (c)
    they understand that attendance is at their own risk.
The Attendee further acknowledges that the Organizer does not provide personal accident insurance coverage for Attendees and that it is the responsibility of each Attendee to obtain any desired insurance coverage.

11.3Compliance with Safety Instructions

The Attendee agrees to comply at all times with:
  • (a)
    posted safety signage;
  • (b)
    public announcements and emergency instructions;
  • (c)
    instructions issued by security personnel, Event staff, or emergency responders;
  • (d)
    crowd control and evacuation procedures.
Failure to follow safety instructions may increase the risk of injury and may result in removal from the Venue in accordance with these Terms.
The Organizer shall not be liable for injury or loss resulting from an Attendee’s failure to comply with safety instructions or from voluntary participation in risky or prohibited behavior.
Attendees acknowledge that outdoor Events may involve prolonged exposure to sun and heat and agree to take appropriate personal precautions, including hydration, sun protection, and weather-appropriate clothing. The Organizer shall not be responsible for health effects arising from an Attendee’s failure to take reasonable precautions against environmental conditions.

12. Release of Liability and Limitation of Liability

12.1Release and Waiver

To the fullest extent permitted by applicable law, each Attendee hereby releases, waives, and discharges the Organizer and the Released Parties from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or in connection with:
  • (a)
    attendance at, entry to, or participation in the Event;
  • (b)
    the inherent risks described in Section 11;
  • (c)
    acts or omissions of other Attendees or third parties not under the direct control of the Organizer;
  • (d)
    lawful security measures, screening procedures, crowd management, or enforcement of these Terms;
  • (e)
    changes to schedule, lineup, production elements, or Event format that do not constitute Cancellation under Section 8;
  • (f)
    any temporary interruption, delay, suspension, or partial performance of the Event.
This release does not apply to liability arising directly from the gross negligence or willful misconduct of the Organizer or any Released Party, or to any liability that cannot lawfully be excluded or limited under applicable law.
Nothing in this Section shall limit any statutory rights that cannot be waived.

12.2Limitation of Damages

To the fullest extent permitted by applicable law, the Released Parties shall not be liable for any indirect, incidental, special, exemplary, or punitive damages arising out of or relating to the Event or these Terms.
No claim arising solely from acts performed within the scope of their authorized duties in connection with the Event shall be brought against any individual director, employee, contractor, or agent personally.

12.3Liability Cap

Subject to applicable law and to the carve-outs set out below, the maximum aggregate liability of the Organizer arising out of or in connection with any claim relating to the Event, whether in contract, tort, negligence, statutory duty, or otherwise, shall not exceed the face value of the Ticket purchased by the Attendee.
Where an Attendee has not purchased a Ticket but attends pursuant to a complimentary or promotional pass, the Organizer’s maximum liability shall not exceed the lowest publicly available Ticket price for the relevant Event, or if no Ticket was publicly sold, a reasonable sum reflective of equivalent access value.
This limitation shall apply regardless of the number or nature of claims and shall survive termination, cancellation, expiration, or completion of the Event and these Terms.
The limitations set forth in this Section apply even if any limited remedy fails of its essential purpose.
Nothing in this Section limits or excludes liability for death or personal injury caused by the negligence of the Organizer or any Released Party, or any other liability that cannot lawfully be limited or excluded under applicable law.

12.4Exclusion of Consequential Loss

To the fullest extent permitted by law, the Released Parties shall not be liable for any loss of profit, loss of income, loss of business opportunity, loss of goodwill, reputational damage, or any other consequential, economic, or indirect loss arising from:
  • (a)
    cancellation, postponement, delay, or interruption of the Event;
  • (b)
    refusal of entry or removal from the Venue in accordance with these Terms;
  • (c)
    schedule changes, lineup substitutions, or production modifications;
  • (d)
    security measures or crowd management decisions.
The Attendee acknowledges that such risks are inherent in live events, subject always to applicable law and the liability carve-outs set out in this Section.

12.5Personal Property Disclaimer

The Organizer shall not be responsible for loss, theft, or damage to personal property brought into or left at the Venue, including but not limited to vehicles, clothing, electronic devices, or other belongings.
All property is brought to and retained at the Venue at the Attendee’s own risk, except to the extent caused by the gross negligence or willful misconduct of the Organizer or any Released Party.
The Organizer does not provide storage facilities or insurance coverage for personal belongings unless expressly stated.

12.6Insurance Disclaimer

The Organizer maintains such insurance coverage as it deems appropriate for its operations; however, nothing in these Terms shall be construed as creating any obligation to maintain insurance for the benefit of any Attendee, Vendor, sponsor, or third party.
Attendees are solely responsible for obtaining their own personal insurance coverage, including but not limited to personal accident, health, travel, or property insurance.

13. Indemnification

13.1Attendee Indemnity

Each Attendee agrees to indemnify, defend, and hold harmless the Organizer and the Released Parties from and against any and all claims, demands, actions, proceedings, liabilities, losses, damages, fines, penalties, costs, and expenses, to the extent directly caused by the Attendee’s acts or omissions, arising out of or in connection with:
  • (a)
    any breach of these Terms by the Attendee;
  • (b)
    any unlawful, negligent, reckless, or willful act or omission by the Attendee;
  • (c)
    damage to property belonging to the Organizer, the Venue, performers, vendors, sponsors, or other Attendees;
  • (d)
    personal injury or death caused or contributed to by the Attendee;
  • (e)
    the Attendee’s misuse or unauthorized transfer of a Ticket or access credential;
  • (f)
    any chargeback, fraudulent transaction, or payment dispute initiated by or attributable to the Attendee where the transaction was validly authorized.
This indemnity shall apply whether the claim is brought by a third party, a government authority, a regulatory body, or another Attendee.

13.2Scope of Indemnified Parties

For the purposes of this Section, the indemnified parties include the Organizer and the Released Parties.
The indemnity obligations set out in this Section apply to claims arising directly or indirectly from the conduct of the Attendee in connection with the Event and shall extend to all reasonable losses, liabilities, damages, and properly incurred legal costs attributable to such conduct, to the extent permitted by applicable law.

13.3Recovery of Legal Costs

The Attendee agrees that the indemnity set out in this Section includes the obligation to reimburse the Organizer and other indemnified parties for all reasonable legal fees, professional fees, investigation costs, settlement amounts, court costs, and related expenses incurred in defending or resolving any claim covered by this Section.
The Organizer reserves the right to assume exclusive control of the defense and settlement of any matter subject to indemnification, without relieving the Attendee of their indemnity obligations.
The indemnity obligations set forth in this Section shall survive the conclusion of the Event and the termination or expiration of these Terms.

14. Medical Treatment and Emergencies

14.1Consent to Emergency Care

In the event of injury, illness, or medical emergency occurring at or in connection with the Event, the Attendee authorizes the Organizer, Venue personnel, security staff, and emergency responders to provide or arrange for first aid, medical assistance, or emergency treatment as deemed reasonably necessary under the circumstances.
The Attendee acknowledges and agrees that:
  • (a)
    on-site medical services, if provided, may be limited to basic first aid or emergency stabilization;
  • (b)
    the Organizer is not responsible for the level or outcome of medical care provided by third-party medical personnel or emergency services;
  • (c)
    the Organizer may contact emergency services or arrange transportation to a medical facility where deemed appropriate.
The Attendee consents to such medical treatment and transportation and releases the Organizer from liability arising from good-faith efforts to provide or arrange such assistance, except to the extent prohibited by applicable law.

14.2Responsibility for Medical Costs

The Attendee acknowledges and agrees that:
  • (a)
    any medical treatment, emergency transport, hospitalization, or related services obtained at or in connection with the Event shall be at the Attendee’s sole cost and expense;
  • (b)
    the Organizer does not provide medical insurance coverage for Attendees;
  • (c)
    the Attendee is solely responsible for maintaining appropriate personal health and accident insurance.
The Organizer shall not be liable for any medical expenses incurred by the Attendee, whether provided on-site or off-site, except to the extent required by applicable law.

14.3Health Disclosure and Personal Responsibility

The Attendee acknowledges that attendance at a live event may involve exposure to loud sound levels, lighting effects, crowd density, environmental conditions, and other factors that may aggravate pre-existing medical conditions.
Each Attendee is solely responsible for:
  • (a)
    assessing their own physical and medical fitness to attend;
  • (b)
    bringing necessary medications, medical devices, or personal support required for their condition;
  • (c)
    managing allergies, sensitivities, or other health considerations;
  • (d)
    seeking medical assistance promptly where needed.
The Organizer shall not be responsible for any adverse health consequences arising from an Attendee’s failure to manage known medical conditions or to follow medical advice.
Nothing in this Section excludes liability for personal injury caused by the gross negligence or willful misconduct of the Organizer or any Released Party, to the extent such exclusion is not permitted by law.

15. Photography, Filming, CCTV, and Media Rights

15.1Event Recording and Surveillance

The Attendee acknowledges and agrees that the Event and the Venue may be subject to audio recording, video recording, photography, live streaming, broadcasting, and continuous surveillance, including by fixed cameras, roaming production crews, drones where permitted by law, security cameras, and other recording technologies.
Recording may occur in all areas of the Venue, including entry points, crowd areas, stages, hospitality zones, and surrounding controlled areas.
Such recording may be undertaken for purposes including, without limitation:
  • (a)
    security and safety monitoring;
  • (b)
    incident investigation and regulatory compliance;
  • (c)
    archival documentation;
  • (d)
    promotional, advertising, and marketing activities;
  • (e)
    commercial exploitation and distribution of Event-related content.
By entering the Venue, the Attendee consents to being recorded in such manner.

15.2Grant of Image and Likeness Rights

To the fullest extent permitted by law, each Attendee grants to the Organizer and its affiliates, licensees, sponsors, partners, and successors the worldwide, perpetual, royalty-free right and license to use, reproduce, record, capture, broadcast, publish, display, edit, adapt, modify, distribute, publicly perform, and otherwise exploit the Attendee’s name, image, likeness, voice, appearance, biographical material, and any statements made at or in connection with the Event (collectively, “Likeness Rights”).
Such rights may be exercised in any media now known or hereafter developed, including but not limited to:
  • (a)
    television and radio broadcast;
  • (b)
    digital streaming platforms;
  • (c)
    social media platforms;
  • (d)
    websites and mobile applications;
  • (e)
    promotional trailers and advertisements;
  • (f)
    sponsor and partner campaigns;
  • (g)
    archival and documentary productions.
Such use shall not falsely imply that the Attendee personally endorses any product, sponsor, or commercial partner.

15.3Commercial and Promotional Use

The Organizer shall have the right to use and exploit Event recordings and related content for commercial, advertising, promotional, sponsorship, and marketing purposes without further consent from, or payment to, the Attendee.
The Attendee acknowledges that:
  • (a)
    recordings may be edited, modified, combined with other materials, or used in promotional contexts;
  • (b)
    the Organizer is under no obligation to use any particular recording or image;
  • (c)
    sponsors and commercial partners may be granted rights to use Event content in association with their brands.
Nothing in this Section obligates the Organizer to identify or credit any Attendee in connection with the use of recorded materials.

15.4Waiver of Approval and Compensation Rights

The Attendee waives any right to:
  • (a)
    inspect, approve, or control the use of recordings or images in which they appear;
  • (b)
    claim compensation, royalties, or other payment in connection with the use of such recordings;
  • (c)
    assert moral rights or similar claims in respect of the authorized use of Event recordings, to the extent such rights may lawfully be waived.
The Attendee further releases the Organizer from any claims arising from the use of their image or likeness in accordance with this Section, except to the extent such claims cannot be excluded under applicable law.

15.5Restrictions on Attendee Recording

Personal photography and video recording for private, non-commercial use may be permitted at the Organizer’s discretion, provided that such recording:
  • (a)
    does not interfere with the performance, production, or enjoyment of the Event by others;
  • (b)
    does not use professional-grade recording equipment without prior written authorization;
  • (c)
    is not used for commercial exploitation, live streaming, rebroadcast, or monetization;
  • (d)
    does not capture restricted areas, security procedures, or proprietary production elements.
The use of professional cameras, audio recording equipment, drones, or live streaming devices without express written authorization from the Organizer is strictly prohibited.
The Organizer reserves the right, where lawful and proportionate, to require cessation of recording, confiscate recording equipment, or require deletion of unauthorized recordings, and to remove any Attendee who violates this Section without refund.

16. Intellectual Property Rights

16.1Ownership of Event Branding and Content

All intellectual property rights associated with the Event are and shall remain the exclusive property of Outright Play (Pvt) Ltd and/or its licensors.
Such intellectual property includes, without limitation:
  • (a)
    Event names, titles, logos, trademarks, service marks, trade names, and branding elements;
  • (b)
    stage designs, set designs, lighting concepts, audiovisual productions, and creative direction;
  • (c)
    recorded audio, video, photographs, livestreams, broadcasts, and other Event content;
  • (d)
    promotional materials, graphics, artwork, and digital assets;
  • (e)
    proprietary systems, ticketing platforms, and Event-related software.
Nothing in these Terms grants the Attendee any ownership interest or license in or to such intellectual property, except the limited right to attend the Event in accordance with Section 2.
All rights not expressly granted herein are reserved by the Organizer.

16.2Restrictions on Commercial Use

Attendees shall not, without the prior written consent of the Organizer:
  • (a)
    use Event branding, logos, trademarks, or copyrighted materials for commercial purposes;
  • (b)
    create merchandise incorporating Event branding;
  • (c)
    use Event names or logos in connection with marketing, promotions, contests, sweepstakes, or hospitality packages;
  • (d)
    represent any affiliation, sponsorship, or endorsement by the Organizer.
The unauthorized use of the Organizer’s intellectual property may result in immediate removal from the Venue and may give rise to legal action.

16.3Unauthorized Streaming and Distribution

The recording, transmission, streaming, rebroadcast, publication, or distribution of any part of the Event for commercial or public purposes without the prior written consent of the Organizer is strictly prohibited.
This prohibition includes, without limitation:
  • (a)
    livestreaming on social media platforms;
  • (b)
    uploading full-length performances or substantial excerpts;
  • (c)
    commercial exploitation of Event recordings;
  • (d)
    creation or sale of unauthorized recordings, digital assets, or derivative works.
The Organizer reserves the right to issue takedown notices, pursue injunctive relief, or seek damages against individuals or entities engaged in unauthorized distribution or exploitation of Event content.

16.4Enforcement Rights

The Organizer reserves all rights to enforce its intellectual property, including the right to:
  • (a)
    refuse entry to individuals or entities reasonably suspected of infringing activities;
  • (b)
    confiscate unauthorized commercial recording equipment where permitted by law;
  • (c)
    pursue civil remedies, including damages and injunctive relief;
  • (d)
    cooperate with law enforcement or regulatory authorities in cases of infringement.
The failure of the Organizer to enforce any intellectual property right on a particular occasion shall not constitute a waiver of its right to enforce such rights in the future.
The rights and remedies set forth in this Section are cumulative and in addition to any other rights available under applicable law.

17. Data Protection and Privacy

17.1Collection of Personal Data

In connection with the purchase of Tickets, entry to the Event, and attendance at the Venue, the Organizer may collect and process personal data relating to Purchasers and Attendees.
Such personal data may include, without limitation:
  • (a)
    identification details, including name and national identification number where required;
  • (b)
    contact information, including email address, telephone number, and mailing address;
  • (c)
    transaction and payment-related information, excluding full payment card details where not stored by the Organizer;
  • (d)
    ticketing history and entry scan records;
  • (e)
    device, browser, IP address, and usage data collected through ticketing platforms;
  • (f)
    CCTV footage and other security recordings captured at the Venue;
  • (g)
    incident reports, complaint records, and correspondence with customer support.
Personal data may be collected directly from the Purchaser or Attendee, through Official Channels, through payment processors, or through security and operational systems deployed at the Event.

17.2Purpose of Processing

Personal data may be processed by the Organizer for lawful purposes including, without limitation:
  • (a)
    ticket issuance, validation, and access control;
  • (b)
    fraud detection, payment verification, and chargeback management;
  • (c)
    safety, security monitoring, and incident investigation;
  • (d)
    compliance with legal and regulatory obligations;
  • (e)
    operational management of the Event;
  • (f)
    customer service and dispute resolution;
  • (g)
    marketing communications, where consent has been obtained or where otherwise permitted by applicable law.
Processing shall be carried out in accordance with the principles of lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, storage limitation, and integrity as required under applicable data protection laws of Sri Lanka.
In accordance with the Personal Data Protection Act, No. 9 of 2022 of Sri Lanka, personal data is processed on one or more of the following lawful bases, as applicable:
  • (a)
    performance of a contract, including the issuance and administration of Tickets and access to the Event;
  • (b)
    compliance with legal and regulatory obligations;
  • (c)
    the Organizer’s legitimate interests, including fraud prevention, security, operational management, and improvement of Event services, provided such interests are not overridden by the rights of the data subject;
  • (d)
    consent, where required under applicable law, including for marketing communications.

17.3Marketing Communications

Where permitted by law, the Organizer may send Attendees updates regarding future Events, promotions, announcements, and related content.
Where required under applicable law, marketing communications shall only be sent where the individual has provided valid consent.
Each recipient of marketing communications shall have the ability to opt out or unsubscribe at any time using the mechanism provided in the communication.
Withdrawal of marketing consent shall not affect the lawfulness of processing carried out prior to such withdrawal and shall not affect processing necessary for contractual, legal, or security purposes.

17.4Data Sharing and Third Parties

The Organizer may share personal data with third parties where reasonably necessary for the purposes described above, including:
  • (a)
    ticketing platform providers and payment gateways;
  • (b)
    banks and financial institutions for transaction processing and fraud management;
  • (c)
    IT service providers and cloud hosting partners;
  • (d)
    security contractors and Venue operators;
  • (e)
    regulatory authorities and law enforcement agencies where required by law;
  • (f)
    professional advisers including auditors, insurers, and legal counsel.
Such third parties shall process personal data under contractual or legal obligations requiring appropriate security and confidentiality safeguards.
Where personal data is transferred outside Sri Lanka, the Organizer shall take reasonable steps to ensure appropriate safeguards are in place in accordance with applicable data protection laws.

17.5Data Retention

Personal data shall be retained only for as long as necessary to fulfill the purposes for which it was collected, including for legal, accounting, dispute resolution, and regulatory compliance purposes.
Retention periods may vary depending on:
  • (a)
    statutory requirements;
  • (b)
    the nature of the transaction;
  • (c)
    the need to defend or establish legal claims;
  • (d)
    fraud prevention and security considerations.
CCTV and security recordings may be retained for a limited period consistent with safety, investigative, and compliance requirements and shall be securely deleted or anonymized thereafter unless required for legal proceedings or regulatory compliance.
At the expiration of the applicable retention period, personal data shall be securely deleted or anonymized in accordance with applicable law.
The Organizer implements reasonable technical and organizational measures designed to safeguard personal data against unauthorized access, accidental or unlawful destruction, loss, alteration, disclosure, or misuse, in accordance with applicable data protection laws of Sri Lanka.

17.6Data Subject Rights

Subject to applicable law, individuals may have the right to:
  • (a)
    request access to personal data held about them;
  • (b)
    request correction of inaccurate or incomplete data;
  • (c)
    request erasure of personal data in certain circumstances;
  • (d)
    object to or restrict processing;
  • (e)
    withdraw consent where processing is based on consent;
  • (f)
    lodge a complaint with the relevant data protection authority in Sri Lanka.
Requests to exercise such rights may be made through the contact details specified in the Privacy Notice.
The Organizer reserves the right to verify the identity of any individual submitting a request before disclosing or modifying personal data.

17.7Reference to Privacy Notice

Further details regarding the collection, use, storage, sharing, and protection of personal data are set out in the Organizer’s Privacy Notice, which forms part of these Terms by reference.
The Privacy Notice is available through Official Channels and may be updated from time to time.
In the event of any inconsistency between these Terms and the Privacy Notice with respect to data protection matters, the Privacy Notice shall prevail.

18. Alcohol, Controlled Substances, and Responsible Service

18.1Age Verification

The sale, service, and consumption of alcoholic beverages at the Event shall be strictly regulated in accordance with applicable laws of Sri Lanka.
Attendees may be required to present valid government-issued identification to verify legal drinking age prior to the purchase or consumption of alcohol.
The Organizer and its authorized vendors reserve the right to refuse the sale or service of alcohol to any person who:
  • (a)
    fails to produce satisfactory proof of age;
  • (b)
    presents identification that appears altered, expired, forged, or invalid;
  • (c)
    attempts to purchase alcohol on behalf of an underage individual.
Any attempt to provide alcohol to a minor or to misrepresent age may result in removal from the Venue without refund and referral to law enforcement authorities.

18.2Refusal of Service

The Organizer and its authorized vendors reserve the right to refuse the sale or service of alcohol to any Attendee at their reasonable discretion.
Without limitation, alcohol service may be refused where an Attendee:
  • (a)
    appears intoxicated or impaired;
  • (b)
    engages in disruptive, aggressive, or unsafe behavior;
  • (c)
    violates these Terms or applicable laws;
  • (d)
    poses a risk to themselves or others.
The Organizer may remove from the Venue any Attendee whose level of intoxication creates a safety risk or interferes with the orderly conduct of the Event.
Removal arising from intoxication or misconduct shall not entitle the Attendee to any refund or compensation, except where required by applicable law.

18.3Illegal Substances

The possession, use, distribution, or sale of illegal drugs or controlled substances at the Venue is strictly prohibited.
The Organizer reserves the right to:
  • (a)
    deny entry to or remove any person suspected of possessing or using illegal substances;
  • (b)
    confiscate prohibited substances where lawful to do so;
  • (c)
    report suspected illegal activity to law enforcement authorities.
The Organizer shall not be liable for any consequences arising from an Attendee’s violation of drug or controlled substance laws.
Any Attendee found engaging in unlawful substance-related activity may be permanently banned from future Events.

18.4Cooperation with Authorities

The Organizer shall cooperate fully with law enforcement agencies, licensing authorities, and regulatory bodies in matters relating to alcohol control, controlled substances, and public safety.
Attendees acknowledge that:
  • (a)
    security personnel may detain individuals temporarily where reasonably necessary to prevent unlawful activity or ensure safety, subject to applicable law;
  • (b)
    relevant information, including CCTV footage, transaction records, and incident reports, may be shared with competent authorities where required or reasonably necessary;
  • (c)
    violations of alcohol or drug laws may result in prosecution independent of any action taken by the Organizer.
Nothing in this Section limits the Organizer’s right to take immediate action to protect public safety, comply with licensing obligations, or enforce these Terms.

19. Accessibility and Special Assistance

19.1Accessibility Requests

The Organizer is committed to facilitating reasonable accessibility arrangements for Attendees with disabilities or special access requirements, in accordance with applicable law.
Attendees requiring accessibility accommodations are encouraged to notify the Organizer in advance of the Event through Official Channels, providing sufficient details of the requested assistance to enable reasonable assessment and planning.
Accessibility accommodations may include, where reasonably feasible:
  • (a)
    designated accessible viewing areas;
  • (b)
    priority entry or assisted access lanes;
  • (c)
    limited seating arrangements where applicable;
  • (d)
    guidance regarding Venue access routes.
All accessibility arrangements are subject to Venue capacity, safety considerations, and operational feasibility.
The Organizer reserves the right to request reasonable documentation or clarification to assess accessibility needs, where appropriate and consistent with applicable law.

19.2Companion Policies

Where an Attendee requires the assistance of a companion due to a disability, the Organizer may, at its discretion and subject to availability, provide for companion access in accordance with a published companion policy.
Companion access, where offered:
  • (a)
    may require prior approval through Official Channels;
  • (b)
    may be limited to one companion per eligible Attendee;
  • (c)
    shall be subject to the same Terms and Conditions applicable to all Attendees.
The Organizer reserves the right to determine eligibility for companion access in a fair and non-discriminatory manner.
Companions must remain with the eligible Attendee in designated areas where accessibility arrangements apply.

19.3Venue Limitations

The Attendee acknowledges that certain Events may take place at temporary or outdoor Venues where structural, environmental, or regulatory constraints may limit the extent of accessibility accommodations.
Such limitations may include:
  • (a)
    uneven ground or grass surfaces;
  • (b)
    temporary staging and infrastructure;
  • (c)
    weather-related conditions;
  • (d)
    crowd density and safety barriers.
While the Organizer shall take reasonable steps to facilitate accessibility, it does not warrant that all areas of the Venue will be fully accessible.
No refund shall be due solely on the basis that certain areas of a temporary Venue are inaccessible, provided that reasonable efforts have been made to accommodate accessibility needs.
Nothing in this Section excludes or limits rights afforded under applicable law relating to accessibility or non-discrimination.

20. Minors and Safeguarding

20.1Age Restrictions

The Organizer reserves the right to impose age restrictions for any Event or specific areas within an Event.
Age restrictions may include, without limitation:
  • (a)
    minimum age requirements for entry;
  • (b)
    restrictions on access to certain zones, including alcohol service areas;
  • (c)
    curfew requirements for minors.
Where an Event is designated as restricted to persons above a specified age, valid government-issued identification may be required as a condition of entry.
The Organizer reserves the right to refuse entry to any person who fails to provide satisfactory proof of age or who does not meet the applicable age requirement.
No refund shall be payable where entry is refused due to failure to meet age restrictions or provide valid identification, except where required by applicable law.
The Organizer reserves the right, acting reasonably, to require written parental or legal guardian consent and/or the physical presence of a parent or guardian as a condition of attendance by minors for certain Events, particularly where content may be mature, explicit, or otherwise age-sensitive.

20.2Guardian Responsibility

Where minors are permitted to attend the Event, they must be accompanied and supervised at all times by a parent, legal guardian, or responsible adult authorized by the parent or legal guardian.
The accompanying adult:
  • (a)
    assumes full responsibility for the minor’s safety, conduct, and compliance with these Terms;
  • (b)
    shall remain present with the minor within the Venue at all times unless otherwise permitted by the Organizer;
  • (c)
    shall ensure that the minor does not access restricted areas or engage in prohibited activities.
The Organizer shall not be responsible for supervising minors or for the actions or omissions of any accompanying adult.
Where a minor is found unaccompanied in violation of this Section, the Organizer reserves the right to remove the minor and accompanying adult from the Venue without refund.

20.3Safeguarding Procedures

The Organizer is committed to maintaining a safe environment for all Attendees, including minors.
The Organizer may implement safeguarding procedures, which may include:
  • (a)
    designated welfare or assistance points within the Venue;
  • (b)
    staff training on safeguarding awareness;
  • (c)
    procedures for reporting concerns relating to vulnerable individuals.
Any Attendee who observes behavior that may place a minor or vulnerable person at risk is encouraged to report such concerns promptly to Event staff or security personnel.
The Organizer reserves the right to take appropriate action in response to safeguarding concerns, including involvement of law enforcement or child protection authorities where necessary.
Nothing in this Section creates a supervisory duty beyond that required under applicable law.

21. Vendors, Sponsors, and Third Parties

21.1Independent Vendor Operations

Food and beverage providers, merchandise sellers, exhibitors, contractors, service providers, and other vendors operating at or in connection with the Event (collectively, “Vendors”) are independent third parties.
Vendors operate under their own licenses, permits, and regulatory obligations and are solely responsible for:
  • (a)
    the quality, safety, and suitability of the goods or services they provide;
  • (b)
    compliance with applicable health, safety, tax, and consumer protection laws;
  • (c)
    pricing, labeling, and representations relating to their products;
  • (d)
    processing and handling of transactions conducted directly with Attendees.
The Organizer does not manufacture, supply, or warrant any products or services offered by Vendors and shall not be liable for any injury, illness, loss, or damage arising from the acts, omissions, products, or services of any Vendor.
Any claim relating to goods or services purchased from a Vendor must be directed to the relevant Vendor.

21.2Sponsor Activations

The Event may include sponsor-branded areas, promotional activities, competitions, sampling campaigns, or interactive installations (“Sponsor Activations”).
Sponsor Activations may be operated or administered by sponsors or their appointed agents and may be subject to separate terms and conditions.
Participation in Sponsor Activations is voluntary and at the Attendee’s own risk.
The Organizer shall not be responsible for:
  • (a)
    the conduct of sponsors or their representatives;
  • (b)
    the administration of competitions, giveaways, or promotional offers conducted by sponsors;
  • (c)
    the collection or processing of personal data by sponsors, which shall be governed by the sponsor’s own privacy policies.
Attendees are encouraged to review any additional terms presented by sponsors prior to participation.

21.3Third-Party Services Disclaimer

The Organizer may facilitate or promote access to third-party services in connection with the Event, including but not limited to:
  • (a)
    transportation providers;
  • (b)
    accommodation partners;
  • (c)
    parking operators;
  • (d)
    ticketing or resale platforms authorized for specific purposes;
  • (e)
    insurance providers.
Such third-party services are provided independently of the Organizer.
The Organizer does not control and shall not be liable for:
  • (a)
    the availability, quality, or performance of third-party services;
  • (b)
    acts or omissions of third-party service providers;
  • (c)
    loss or damage arising from reliance on third-party services.
Any arrangement made between an Attendee and a third-party service provider are entered into solely at the Attendee’s risk and subject to the terms of that third party.
Nothing in this Section limits any liability that cannot lawfully be excluded under applicable law.

22. Lost Property, Parking, and Transport

22.1Lost and Found

The Organizer may, at its discretion, operate a lost and found service during and for a limited period following the Event.
Any property found within the Venue may be collected and held for a reasonable period determined by the Organizer.
The Organizer:
  • (a)
    does not guarantee the recovery of lost property;
  • (b)
    shall not be liable for loss, theft, or damage to personal belongings brought to or left at the Venue;
  • (c)
    may require reasonable proof of ownership and identification before releasing recovered property.
Unclaimed items may be disposed of, donated, or otherwise handled in accordance with applicable law after the expiration of the retention period.
Attendees are solely responsible for safeguarding their personal belongings at all times.

22.2Vehicle and Parking Disclaimer

Parking facilities, whether on-site or off-site, may be operated by the Venue or by independent third-party parking providers.
All vehicles are parked at the owner’s sole risk.
The Organizer shall not be liable for:
  • (a)
    loss, theft, or damage to vehicles;
  • (b)
    loss or theft of items left inside vehicles;
  • (c)
    towing, fines, or penalties imposed due to improper parking;
  • (d)
    acts or omissions of parking operators.
Where parking is offered in connection with the Event, such parking does not create a bailment relationship between the Organizer and the vehicle owner.
Attendees are responsible for complying with all posted parking regulations and applicable traffic laws.

22.3Third-Party Transport Disclaimer

Transportation services to and from the Event, including taxis, ride-sharing services, shuttle operators, buses, trains, or other transport providers, are independent third-party services.
The Organizer does not operate or control such transportation services and shall not be liable for:
  • (a)
    delays, cancellations, or service interruptions;
  • (b)
    accidents, injuries, or incidents occurring during transit;
  • (c)
    pricing, fare disputes, or service quality issues;
  • (d)
    loss or damage to personal property during transit.
Any arrangement for transportation is made solely between the Attendee and the relevant service provider and is subject to that provider’s terms and conditions.
The Organizer shall not be responsible for an Attendee’s inability to attend or depart from the Event due to transport-related issues.

23. Complaints and Customer Support

23.1Contact Procedures

Any complaint, inquiry, or request relating to Ticket purchases, Event operations, or these Terms must be submitted through the official customer support channels designated by the Organizer.
Contact details and submission procedures shall be published through Official Channels.
Complaints must include sufficient detail to enable proper review, including:
  • (a)
    the Purchaser’s full name and contact information;
  • (b)
    order number or Ticket reference number;
  • (c)
    a clear description of the issue;
  • (d)
    the date and time of the incident where applicable.
The Organizer shall make reasonable efforts to respond within a commercially reasonable timeframe. Response times may vary depending on volume and complexity.
Submission of a complaint does not guarantee refund, compensation, or resolution in the Attendee’s favor.

23.2Time Limits for Claims

To the fullest extent permitted by applicable law, any claim relating to:
  • (a)
    Ticket purchase issues;
  • (b)
    alleged misconduct or removal;
  • (c)
    Event operations;
  • (d)
    loss, damage, or personal injury occurring at the Event;
  • (e)
    refund eligibility,
must be submitted in writing to the Organizer within fourteen (14) days of the Event date or the date on which the issue arose, whichever is earlier.
Failure to submit a complaint within this period may result in the claim being deemed waived, except where a longer limitation period is mandated by applicable law.
Nothing in this Section limits any statutory rights that cannot lawfully be restricted.

23.3Required Documentation

The Organizer reserves the right to request reasonable supporting documentation before assessing any claim, including but not limited to:
  • (a)
    proof of purchase;
  • (b)
    identification verification;
  • (c)
    photographs, video, or other evidence of the alleged issue;
  • (d)
    medical documentation in the case of injury claims;
  • (e)
    correspondence relating to the matter.
Failure to provide requested documentation within a reasonable timeframe may result in rejection of the claim.
Where a claim involves an allegation of personal injury, property damage, or misconduct, the Organizer reserves the right to conduct an internal investigation and to request cooperation from the claimant.
Submission of false, misleading, or fraudulent claims may result in denial of the claim and restriction from future Events, without prejudice to any legal remedies available to the Organizer.

24. Governing Law and Dispute Resolution

24.1Applicable Law

These Terms, and any dispute, claim, or controversy arising out of or in connection with the Event, the purchase or use of any Ticket, or attendance at the Venue, shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
This governing law clause applies regardless of the Attendee’s country of residence, place of purchase, or method of payment, subject to any mandatory consumer protection provisions that may apply under applicable law.

24.2Jurisdiction

Subject to Section 24.3, the courts of Colombo, Sri Lanka shall have exclusive jurisdiction over any matter not subject to arbitration under these Terms and for the enforcement of arbitral awards.

24.3Escalation and Mandatory Mediation

  • (a)
    Good Faith Negotiation
Prior to initiating formal legal proceedings, the Parties shall attempt in good faith to resolve any dispute through written notice and direct negotiation. The Party raising the dispute shall provide written notice setting out reasonable details of the claim, and the Parties shall allow a period of at least fourteen (14) days for discussions.
  • (b)
    Mandatory Mediation
If the dispute is not resolved through negotiation, the Parties agree to submit the matter to confidential mediation conducted in Colombo, Sri Lanka, before commencing court proceedings.
The mediator shall be mutually agreed by the Parties. If no agreement is reached within fourteen (14) days, either Party may initiate proceedings before the courts of Colombo, Sri Lanka.
The Parties agree to participate in mediation in good faith.
  • (c)
    Urgent Relief
Nothing in this Section shall prevent the Organizer from seeking urgent interim, injunctive, or protective relief before the courts of Colombo, Sri Lanka, where necessary to protect intellectual property rights, prevent fraud, ensure safety, or enforce payment obligations.

24.4Individual Claims Only; No Consolidation Without Consent

To the fullest extent permitted by applicable law, any dispute, claim, or proceeding arising out of or in connection with these Terms or the Event shall be brought solely in an individual capacity and not as part of any collective, consolidated, representative, coordinated, or group action.
No Party shall seek to consolidate any claim with the claims of other individuals, nor pursue any representative or coordinated proceeding, without the prior written consent of the Organizer.
Nothing in this Section shall limit any rights that cannot lawfully be restricted under applicable law or prevent a court from exercising its inherent procedural powers where required by law.

25. General Provisions

25.1Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable while preserving its original intent as closely as possible.
If such modification is not possible, the relevant provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions, which shall continue in full force and effect.
The Parties agree that any invalid or unenforceable provision shall not affect the enforceability of the remaining provisions.

25.2Entire Agreement

These Terms, together with any policies expressly incorporated by reference, including but not limited to the Privacy Notice, Refund Policy, and any published Event-specific conditions, constitute the entire agreement between the Organizer and the Purchaser or Attendee in relation to the Event.
These Terms supersede all prior or contemporaneous communications, representations, understandings, or agreements, whether oral or written, relating to the subject matter herein.
No statement, advertisement, marketing material, or representation not expressly incorporated into these Terms shall create any binding obligation on the Organizer.

25.3No Reliance

The Purchaser and Attendee acknowledge that, in entering into these Terms and purchasing or using a Ticket, they have not relied on any representation, statement, promise, assurance, or warranty not expressly set out in these Terms.
No oral statements, promotional materials, social media content, advertisements, sponsor communications, or informal communications shall create any binding obligation on the Organizer unless expressly incorporated into these Terms.
Nothing in this Section shall exclude or limit liability for fraud or any liability that cannot lawfully be excluded under applicable law.

25.4No Waiver

The failure or delay of the Organizer to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Any waiver of a right under these Terms shall be effective only if made in writing and signed by an authorized representative of the Organizer.
A waiver of any breach shall not operate as a waiver of any subsequent breach.

25.5Assignment

The Organizer may assign, transfer, delegate, or subcontract any of its rights or obligations under these Terms to any affiliate, successor entity, event partner, or third-party service provider without prior notice to the Attendee.
Purchasers and Attendees may not assign or transfer their rights or obligations under these Terms except in accordance with the Ticket transfer provisions set out herein.
Any unauthorized assignment by an Attendee shall be void.

25.6No Third-Party Beneficiaries; No Agency

Except as expressly provided in the definition of “Released Parties” and in any provision granting rights, protections, limitations of liability, indemnities, or releases in favor of the Released Parties, no person other than the Organizer and the Purchaser or Attendee shall have any right to enforce these Terms.
Nothing in these Terms shall be deemed to create any partnership, joint venture, agency, employment, fiduciary relationship, or similar relationship between the Organizer and any Vendor, sponsor, Venue operator, contractor, artist, or other third party.
No third party shall have authority to bind the Organizer unless expressly authorized in writing.

25.7Amendments and Updates

The Organizer reserves the right to amend or update these Terms from time to time.
Any material amendments prior to the Event shall be published through Official Channels.
Continued use of a Ticket, attendance at the Event, or entry to the Venue following publication of updated Terms shall constitute acceptance of such amendments.
No amendment shall retroactively deprive an Attendee of any statutory rights that cannot lawfully be limited.

25.8Interpretation

Headings and section titles are for convenience only and shall not affect interpretation.
References to “including” or similar expressions shall be construed as illustrative and not limiting.
References to the singular include the plural and vice versa where the context requires.
These Terms shall not be construed against the Organizer solely by reason of having drafted them.
In the event of any inconsistency between these Terms and any Event-specific addendum or policy expressly incorporated by reference, the Event-specific addendum shall prevail to the extent of the inconsistency.

25.9Survival

The provisions of these Terms which by their nature are intended to survive the completion, cancellation, expiration, or termination of the Event shall remain in full force and effect.
Without limitation, the following Sections shall survive:
  • (a)
    Release of Liability and Limitation of Liability;
  • (b)
    Indemnification;
  • (c)
    Assumption of Risk;
  • (d)
    Photography, Filming, CCTV, and Media Rights;
  • (e)
    Intellectual Property Rights;
  • (f)
    Data Protection and Privacy;
  • (g)
    Governing Law and Dispute Resolution;
  • (h)
    any provisions relating to payment obligations, chargebacks, or fraud prevention.
Survival of these provisions shall apply regardless of whether a dispute arises before or after the Event date.
